Why should the govt. care about losing these cases? It's only our taxpayer money they're playing around with, after all. No skin off their back, so they'll keep pushing trails. Govt. has nothing to lose here, really.

I guess what I'm saying is that you can't out-wait a bureaucracy. They've decided trails are good, rails bad, and they won't stop pushing until they get their way. Even if it takes decades and billions of wasted $$$.
